The New Compliance Standard

On 1 July 2025, SafeWork NSW became an independent regulator with expanded powers under the Standalone Regulator Act 2025.

At the same time, Section 26A of the Workplace Protections Act 2025 created a new legal duty:

  • If a Minister approves a WHS Code of Practice, every PCBU must either comply with it directly, or
  • Prove they are doing something equal or better.

This change is simple but significant. WHS Codes are no longer advisory, they are enforceable benchmarks.

This shift is less about doing more and more about proving more.

  • It’s not enough to say maintenance was completed, you need documented evidence it complied with the Code.
  • If contractors cut corners, you’re still accountable.
